My husband and I live with his parents on their property, and have for 2 1/2 years. Can
My sister-in-law evict only me and not my husband just because she does not like me?
She doesn't even live on the property as she has her on residence. We do not have a
Rental contract of any kind, and do not pay any monies to his parents. Can she do this legally? as I have received my Eviction Papers. It just does not seem right, Can you please help me answer these questions??

Only the person who owns the property or that person's authorized representative can evict a tenant (which includes guests). Unless something is missing here she has no legal standing.

In addition to Judy's answer, one can't evict only one spouse.

As the previous posts state, she doesn't own the property so no she can't.

Surely your husband would not stand by and let this happen!!

Also if the husband is allowed there, he is allowed to have his wife with him, so they will have to evict both.

If she doesn't own the property she has no right to evict you. The property owner has to give appropriate notice - there's a specific legal process involved. It sounds like your free residence there is an issue in the family though, so you might dconsider working toward paying rent or, better yet, moving on when you can afford to do so.

I would have your husband do the negotiations within his family. It's unfair for you to take the heat alone. It cannot be pleasant to life where your very presence causes family disent though, so perhaps the best course of action is to make plans for realistically moving on - not on your sister in law's terms, but when it's agreed to and feasible for you and your husband and his parents- the property owners. You haven't said whether they want you to move? Is the sister in law acting on their behalf?
