Why do you need a passport ? To go out of the country your going to need his permission.

Well, I have family in Mexico and not to mention just for travel. I've been reading that now everyone has to have a passport even to go on a cruise, which we have plan for next summer. And like I've mentioned I have no idea where he is and how to get a hold of him. He's never paid child support so that doesn't matter but not even the child support office has been able to locate him. So my question again is what can I do and what are my rights?

You can hire a private investigator to try to locate him. Because Calif already pointed out you have to have permission (his signature on the child's passport) in order to go out of the country.

Contact the Passport office of the State Dept. They can tell you what documentation you can provide in lieu of the absent father's signature.
