    Petition relative
    I am an immigrant here, recently filed a divorce. I have 2yrs for me to be eligible to apply for citizenship. My question is. I want to petition my mom who was here already in united state and she overstayed. What should I do first? Can I petition her now? Should I apply for waiver? Please help me:confused:

    To be able to file a petition for your mom, you must be US citizen. When you are LPR (greencard holder), the law limits eligibility to spouse and unmarried child/chidren only.

    Since your mom has already overstayed her visa for quite a number of years, the best bet is having experienced immigration attorney take care of this matter.
