    Mom says she is legal guardianship of my son so what do I do
    A while back I got into a fight with my mom and she ended up kicking me out so I went and lived with my other half for a couple weeks whom lives with his parents so I wasn't able to bring my son. I tried to go back about two weeks after getting kicked out and she said I wasn't aloud back and wouldn't let me take any of my stuff and she ended up calling the cops. My mom said she would take care of my son and the cops asked if I was taking him or leaving him with my mom and I said I wasn't able to have him where I am living. Later on I signed a paper allowing my mom to take my son to the doctors and other appointments without me there and made sure that I wasn't appointing guardianship. Now my mom is saying she is guardian and that she went to court but I thought I would have to go to.

    I was wondering how I would go about trying to find out if I am still the legal guardian cause I am planning on leaving the state and my moms trying to say I can't take my own son with me. So any help and advice would be greatly appreciated. Thanks

    Go to the courthouse and speak with the Juvenile Clerk and see if any such guardianship paperwork was entered or signed by a judge. Usually the Probate and Juvenile judges are the same. Be sure to have ID on you when you ask about your son and mother at the clerk's office. Your mom might be fibbing on this guardianship stuff. Only the Clerk's office can tell you.

    If you don't establish a home in the very near future, where you can take care of your child, you WILL lose custody.

    It is possible if you signed full guardianship over to your mother that she went to Court and had it formalized.

    Go the Family Court in your area and ask -

    But be prepared if your mother wants to fight you on custody to explain how you left and didn't take your child with you - as well as why it took you two weeks to go back for him.

    If you move to another State who is going to care for your child?
