My spouse died 2 months ago. We owned a home jointly. Can I remove my spouse's name from the deed, in order to sell the home, or will I have to go through probate? I live in Michigan.
Look at the language in the deed. Is it 'tenants in common', or 'joint tenancy with right of survivorship'? Or something else?
You won't have to remove the name if you have joint tenancy, you can just sell the home and provide your attorney with a copy of the death certificate and you will be fine.
