    Business right of business or sale law
    Durable medical equipment company , we advertise the product , the customer comes into our store , we have the doctors prescription , we order the physical evaluation or pt. eval.
    In return the physical therapist company refused to do the paperwork for our company and referred to a different company (basically they get some kind of kick back we have great reputation , this has happened several times, With our previous customer we set it up , thewy were told we were small ,never heard of us , they don't have a website , I can't find them anywhere , our customer argued to the point they were going to leave their store if they did not fax us the prescription .
    Question has this company broken any type of law with this customer or the ones lost .


    Note medicare also notes one can not pay a company for referals or give gifts over ten dollars ,
    I would not bring this up to the company unles it would be beneficial , or it could even hurt our company even more financially

    If this is being billed or charged though Medicare yes it is against the law, to refuse, they can recommend. You report them to medicare for violation. If you want you have a rep go over there and explain that too them . But what your reps need to be doing is visiting them, you should have a sales rep that does nothing but visit doctors office, taking lunches and monring donuts, and getting referrals from the doctors.

    I did that for 6 years in TN, if and ony if they would not work with us, I would play hard ball and explain they could not refuse us.

    As long as your DME company is certified to do business with medicare of course. Have you went though accredition with one of the couple groups that review DME firms, Do you have one of your techs certified as a Assertitive Technology Practitioner yet.

    These are all things that are coming down the road, it is going to be very hard for the little guy to stay in business if they don't start now getting on the ground floor of the new laws that are coming.

    Also it is a cut throat business, some of the national companies will even pay off your employees ( like the girl at the phones) to give them leads of people you are dealing with.

    But once you get the certificate of medical neccassity, the other firm is not suppose to be able to do anything without that.
