    How to get your X to move out
    My X an I have lived together for about 3 years. We have been split up for about a year... she refuses to move out. I own the home, her name is not on any document that pertains to the home. What do I have to do? Should I get an eviction notice served? :confused:

    The laws concerning this sort of thing may be dependent on where you live, so it would be good to know where the location is where this is happening.

    Thanks for responding. I'm in Michigan. It may be helpful to know also that we were never married.

    Did the two of you ever have any landlord / tenant agreement? Was there a specific arrangement for her to pay rent?

    If she has unpaid rent you could give her the necessary "pay or quit" notice. Typically 3 or 5 days.

    If there's no payment arragements, or if she's paid up, then she's just a month-to-month tenant. You would simply give her notice (30 day, 60 day) according to your state's laws. Then if she doesn't leave you would begin eviction proceedings.

    Conduct all communications with her in writing so you have a paper trail.

    I guess depending on how bad you want her out you could pay her to leave?

    Bottomline is she has established residency so she has to be evicted according to the rules for your locality.

    Thank you all for your responses, they have helped give me direction. We only had a verbal agreement for "help" with the payment. I will contact my local municipality to find out what I have to do.
