    Coninuing garnishment
I received a continuing garnishment on someone who does contract work for me. I do not hold out taxes because this person is considered to be self-employed. There is no set amount as the work is paid for according to what is done, nor is it an every week event. How do I respond to this first anwer? I do not owe this person anything at this time. And when I do contract work, am I supposed to hold all their money or a percentage of it?

If the person is not "employed" by you, you have no obligation to withhold on a garnishment.

Simply respond that this person is self employed, you owe them nothing at this time, and you feel you received this garnishment order in error.

First of course is he a 1099 worker, Is the work they are doing qualify for this, or should they be a real employee.

If you are paying them under the table, and they should be a employee, then you may be held liable for correct garnishment, if they are a real 1099 employee, you may or may not have to do the garnishment
