I woiuld say it is doubtful that he will get permission, In fact he may have a long wait to return. Have you considered moving to live with him in his country

Yes but if my baby is born in his country( brazil) will my baby be able to come back to the us when time comes without problems, would she still be a us citizen or a citizen of brazil?. am concerned about this

If you are US citizen, your child will be US citizen no matter where she's born. The only thing you need to do is contact the nearest US embassy with your passport and her birth certificate to report birth of US citizen overseas. The baby will be eligible to obtain US passport immediately.

If your husband was deported on ground of unlawful presence, you should retain an experienced immigration attorney to file immigrant visa for him. You would need to a file a waiver first. I believe you have a strong case, but need professional help.

    Good luck.
