First, you can use any name you want as long as there is no intent to defraud. So when you register your daughter, tell them that she uses your fiancee's last name and that he is in the process of formally adopting her, so you want his name used in school. The school should not have a problem with this.

But you will need to seek an attorney's assistance in preparing the adoption papers. The attorney will do what's necessary to get the bio father's rights terminated.
