    Paternity and custody battle with father
    Hi I am 9 months pregnant and the father of my baby hasn't been involved with this during my whole pregnancy and he wants a paternity test after that babies born. He said that if its his, he wants custody of the baby, but he's on drugs, he has no job and no home. What are the chances of him or his grandparents getting custody of my child? I want to get full custody of my son, and do I have to give my son my last name to get full custody.

    He would have to file for custody - he, not his grandparents - you would go to Court. The Judge would hear both sides and issue a custody order ALSO a support order.

    No, if you are not married you can give your child your last name. He cannot force you to give the child his name. He has no legal rights until paternity is established by DNA.

    It is unusual for a mother to lose custody unless he is unfit.

    How old are you? Why are his grandparents involved?

    You aren't the only one in this predicament and, quite frankly, I never understand and I've never asked. Why were you having sex with this guy when you say he's an unemployed drug addict, no job, no home? Women post in this same vein all the time and I just don't understand it.

    But what you name the child has no bearing on who has what custody rights or not. Normally a father is not going to be given full custody 1/2 is about best unless they prove mother is not fit.

    Now of course a homeless man with no job and uses drugs. This is about a great person to be having sex with?? You chose him as the father of your child
