My question is if a person deposits a check and it has not cleared and a stop is put on it the same day its deposited will it work?

Yes, the stop payment happens at the clearing center basically, where it is not accepted. It is not stopped at the actual bank when they deposit it, after they deposit it, they will just be charged back for it when it does not clear.

You have not mentioned reasons for non payment. Hence reply could not be sent.

If a check is stopped the moment it is deposited... thats it... it's STOPPED
