    Breaking a lease
    I have rented this house for 1 year 10 months. The lease ends in 2 months, we found this awesome deal and we are buying a home.. Our landlord says we have to pay the 2 months... I was under the understanding that SC was a no lease stae, That that cannot be inforced... The house was a once in a lifetime deal we informed landlord at least 45 days before we are moving. And never once did she try to rent it..

    What are our rights.

    No, they may well inforce the lease, you have a contract and was happy for that protection while you wanted it. But they can not double rent, so if they rent it out prior to the end of that period, you can not be charged with that.

    Yes , but she is not trying to rent it.. If we gave 45 days, she could have tried to rent it No??

    And there is the point, she is required to list it for rent and try, there are a few states where you don't have to, but SC I don't believe is one of those.

    So she sues you for the rent, you go to court, and you prove she did not try to rent it. Or you pay and sue her for the money back if she does not rent it, or if she does either way.
    Does not really have to list it for rent till the day you move normally.
