    Month to Month Lease
    I need some help. Can somebody tell me the number of days required for the tenants to notify their landlord to vacate the property they are leasing on a month to month. The property is located in Florida. Thank you:)

    If it is a written month to month, it will be the number of days listed on the lease.
    If there is no written lease, it will be 30 days, and it should be from rent due date to rent due date.

    83.03 Termination of tenancy at will; length of notice.--A tenancy at will may be terminated by either party giving notice as follows:

    (1) Where the tenancy is from year to year, by giving not less than 3 months' notice prior to the end of any annual period;

    (2) Where the tenancy is from quarter to quarter, by giving not less than 45 days' notice prior to the end of any quarter;

    (3) Where the tenancy is from month to month, by giving not less than 15 days' notice prior to the end of any monthly period; and

    (4) Where the tenancy is from week to week, by giving not less than 7 days' notice prior to the end of any weekly period.

    LILL has listed the statute, but note that' it refers to the end of the rental period. What it means is that the tenant is responsible for the rent to the end of the rental period, no matter how much notice is given. So lets say the rental period is a calendar month, the tenant can give notice on the 10th but would still be responsible for the whole month. But if the tenant gives notice on the 20th, they would be responsible for the whole following month.
