    Can they charge me double?
    Hi,

    Today me and my husband noticed that we were going to be over $7,000 in the hole in our bank account.Come to find out our old landlord put a restiction on our account for money we owe him.We already went to court over this and we are not disputing the issue of oweing him this money.

    The question is... we owe him a little over $3,000 so why would he be asking for over double of what we owe him?

    Is this legal?

    When an account gets frozen, the amount is usually inflated, to cover other possible charges such as interest, that may have caused the original amount to increase over the time between the judgment and the freeze of the account.

    He will only be able to receive the amount he was awarded, along with interest or fees, if they were outlined in the judgment or are based on the local laws.

    Once he gets the proper amount, the rest will be released and still in your account.

    If he froze the account it means he has a judgement, he can collect only the amount of the judgement, did you not go to court?

    But you can get a copy of the judgement from the court. There will be most likely some interest, some legal fees maybe and of course court costs added to the original amount. But yes they do often freeze more than the actual amount.
