All other issues aside you (such as the rights of the father) you cannot adopt him until you are legally married and that marriage is stable for over a year.

The father will have to sign over his rights to adopt. You will have to show you can properly provide for the child and they will look to see how stable and long lasting relationship you have. How many years you have been together, since you are not married yet. Some states may require you be married first

What if the father refuses even know he haven't had contact for a while but the mother agrees to the adoption

Then the answer is - no. The father NEEDS to consent unless there are unusual circumstances such as he's in prison for life.
