Emancipation for a 15 year old
My sons girlfriend had a baby. Now her mother says she can take the baby from them? We live in Indiana and need to know what we can do to have her emancipation.

Here is the Indiana emancipation law

Age requirement of at least 16 years old. The child must be able to support himself and manage their own affairs. Most of all the child has to be living separate from the parents for some time and the parents must be in favor of granting emancipation.

If the child receives permission from the court to be emancipated then the parents or the guardians are not responsible for the child. That means they are not obligated to provide money, medical insurance or any other kind of support.

When emancipation is granted to a minor there are also requirements that the minor must meet due to some restrictions placed on an emancipated minor. The emancipated minor cannot own or purchase a firearm. Also the emancipated minor cannot purchase cigarettes or alcohol. The minor must also wait until he/she reaches legal age to drink alcohol in the state. School is a must and the emancipated minor must attend or show proof of a high school diploma.

An emancipated minor can get medical care, apply for a work permit, sign up for school and go to college and live where he/she desires. Basically the emancipated minor is treated like an adult in all situations.

If emancipation is the answer then the child has to go to the appropriate juvenile court to start the proceedings. When emancipation is granted the minor should keep the paperwork on them at all times to prove that he/she is an adult.
