    Want to move with daughter out of state
    I have a 9 month old daughter and my daughter's father has not helped me with her and has not given me any money to support her, so I want to move from California to Texas to be with my family. We were never married and we have no child custody orders. Can I move to Texas with my daughter and not have any problems with the law?

    I would imagine so. Since there is no custody orders in place, you can take your child where you want.

    He might be able to have you arrested if you're to move out of state with her but I would call around and ask before making the move. I know that since my fiancée and his ex were married neither one can take their daughter out of state without the others permission. But since no child custody order is in effect then you should be able to move where ever you'd like to move to.

    The only way the father could have you arrested is if you violated an existing court order to allow visitation. As long as there is no court order for custody/visitation, you are free to move.

    As long as his name is not on the birth cercificate. That's the only way he has any obligations to this child. And whether legaly you can or can not you would not be risking much to do so.

    Is his name on the birth certificate? If so, then I would consult a lawyer before making any decisions.Even though he may not have supported your child financially/emotionally, he could get a bug up his butt and decide he wants to stir things up if you take here.If his name is on the BC, he is legally the father and you may have to get his permission.

    Check with your state laws to safe guard it.
