    Credit Card Debt
    I am in major credit card debt. I have racked up almost 40 grand in debts. I did this without my spouse knowing. I am currently going to DA. I signed up with ABLE debt settlement. I really want to pay off these debts. I am just over my head in debt. Bank of America says that they will sue me. Is it possible to negotiate terms to repay all creditors (5)? I have $350 per month I can pay. A second party for Bank of America says that they will not work with me. Also, how will I know if I am about to be sued? They threaten every day. They say it will be in the courts by the end of the month.

    Welcome to AMHD. I'm not trying to pile on, but can you file Chapter 7 w/o your spouse knowing?

    Like George said, I'd hate to bring it up, but if you can only afford to pay 350 a month, that's 4200 a year. Given this, even with a GREAT lawyer that can potentially cut your settlement by half, it'll take you about five years to pay this debt off, in which case, I doubt cc companies are willing to do.

    My advice is to speak to a debt consolidator, and they may be able to offer you some options.

    My spouse does know about the debt now. Not too happy as you can imagine. I do not know if you can do a chapter 7 in WI without a spouse since we are a everything together kind of state! I am going to meet with a lawyer on Monday. A program through my job offers one free visit. Any more advice is appreciated. Thanks.

    Just a follow-up on the Chapter 7; whether to bring in your spouse on such a decision is a big issue because if you were to make a joint credit application during the next few years, your spouse would probably find out. Anyway,
    "9. I am married. Does my spouse also have to file bankruptcy?
    No. In some cases where only one spouse has debts, or one spouse has debts that are not dischargeable, it might be advisable to have only one spouse file. You must be careful about filing separately if, as a couple, you own joint debt and property."
