    Child support and college
    I was hoping someone could help me. My husband as a son who lives with his mother. He starts college in the fall and will be dorming. Does my husband still need to pay child support to his mother since he technically is not living at home? I live in the state of NY and the divorce decree doesn't state a age to stop paying child support. No mention of college or anything. Can someone please help? Any information who be appreciated.

    If the support agreement doesn't mention when support stops then NY Law applies which states they are responsible for support until 21. Is your husband paying the full costs of college? Does he pay for room and board?

    He does not have to pay for college. Actually, his son is getting everything paid for through financial aide. Is there anyway to pay the son the portion of child support versus the ex-wife?

    I don't believe so. Child Support goes to the custodial parent. Even though he may not be living at home the majority of the year, she's still the custodial parent.

    Sk to have the money put into an account and for both parents to contribute to that account so your son has a collage fund to draw from. Sort of like a prepaid visa card type thing. The courts may allow that and your ex doesn't have to decide if she wants to support him or not.
