    Credit card debt
    A company bought out my credit card debt, they now have the amount at 10,338
    It was bought in 11/2005, the last payment on the card was 11/2002, at the time they bought it I had a Guardian, and was declared incapacitated and the mail went to the Guardian, in 3/2007 the Guardian was released, now the company is trying to find me to sue me in court, the only thing I own is a 2002 Doge, paid for, I am so scared, I am on SS disablity, my total monthly income is aabout $750

    What State? The Statute varies.

    Your SS cannot be garnished for credit card debt - it's a protected asset (except for matters such as student loans and child support).

    If the company obtains a Judgment they can move against bank accounts but only to the extent of the money not from SS.

    They will have no interest in seizing your car - they will "probably" obtain a Judgment (if you don't present a viable defense) which will simply sit around, unpaid, forever or until your financial situation changes.

    Nothing to be taken lightly, of course, but nothing to lose sleep over. You're going to be OK.

    The state is Michigan, I get SS Disabilty and back owwed child support, the total together is only 750, can they attach the child support then, and a lawer said they may be able to go after my car. I live in an apartment and all I own is my car.

    Can you qualify for any type of free legal aid? I 'd try to find out what liability the quardian has in all of this. If this all transpired prior to the guardian being released I believe they'd have a HUGE responsibility here. What other things did they sweep under the rug?
