The HOA should not proceed without an Attorney - very complicated matter if foreclosure is looming.

The HOA should have an attorney on retainer to do these things. If the property is mortgaged, then the lender has a primary lien. In a foreclosure, its unlikley that there will be enough left from the sale of the property to payoff a secondary lien.
