Can someone put a hold on my SSI & Pension account to get their money I owe them?
Yes, they can freeze the account.
It is up to you to prove that the funds in the account would be exempt if that is the case.
If you know you got a judgement I would run not walk to my bank and let them know ssi is exempt because once the check is deposited it is up to you to prove what funds are ssi
And once the account is frozen it could take a few days to straighten it out.
Slowandeasy, you are correct. Sort of. If the funds going into the account are exempt, definitely go to the bank and ask them to release the funds. BUT, if ANY other funds even a single $1 are deposited into the account anytime over the last year, the creditor still has the legal athority to ask the court t put a freeze on the account. I would recommend opening a separate account that ONLY has funds coming from SSI or anything else that is exempt. If any other money needs to get to the account holder, give them cash.
Hope that helps. This just happened to my father. It sucks!
