    Eviction due to complaints in sc
    I recently moved into an apartment community. I have three teenagers, my daughter is 15 and I have two sons 17 and 18. I received a phone call from one of the office girls about two weeks ago stating that my daughter was at our apartment's pool with some kids from the apartment community next door, this was not allowed. My daughter stated to me that she was with the group but another tenant invited those kids over. I received another complaint a week ago stating that my daughter was hanging out in the breezeway and this was not allowed. They called the police this time. I received a phone call today saying that my sons have had friends over (duh) and some residents were scared to come home because they were outside in the parking lot. She also mentioned they must be dealing drugs. This time she stated that with three complaints they would have to file eviction. Is this legal? I must add there are no parties going on, the boys are not loud. They are teenagers with friends.

    If your children are not obeying the rules you can be evicted. Do you have a printed set of "rules" or are they posted somewhere?

    Is this some sort of senior complex and so your kids stand out? I am somewhat surprised that the Police were called and responded - has this been a continuing problem?

    And what is loud or disruptive is in the eyes of the beholder. Are there other tenants with children in the complex?

    I think I would sit down and meet with management and see what the story is here - maybe you're being discriminated against and maybe not. I think you need more info.

    Where are you when this supposed behavior is going on?

    Yes, I do hate to say I have gotten one of my neighbors evicted this month because of loud music. And yes while I did not do it this time, tennants living in my complex were stopped by the police for sitting on the steps ( blocking the steps). Also many older residents are often scared of larger groups of teens hanging in a area. This is a sad state of our world.
    As for as dealing drugs, they would not be hanging, they would have differnet people coming and going from the group normally with a lot of traffic to their area.

    Well, this isn't going to work out for you... It sounds like you have moved into Gestapo Arms Apartment's.

    You're going to have to get TOUGH with the management, or you're going to have to move. I don't know what kind of demeanor you have. If it was ME, I'd get tough - REAL DAMN TOUGH.

    Teenagers are allowed to live too...

    If there are PRINTED rules that say people can not loiter in breezeway, then you opened yourself up to this kind of abuse. However, if it doesn't, and they're only doing this to your teens, and they don't do it to adults, then it's time to write 'em a letter.

    In your letter, which you're going send certified, return receipt requested, you're going to inform them of the RULES, and you should quote them, and how they are violating them... And, that if they continue to violate the provisions of your lease, that you will SUE them...

    Send a copy to the OWNER & the Property Manager, and to anybody else that you can think of.
