    Am I responsible for my husbands debt?
    My husband is currently in a law suit that MAY require his having to pay. He has not received a paycheck from our business (corporation) in the last year. So what I want to know is if he does have to pay and we can't afford the whole amount, will they garnish my wages and/or take any of our personal assets? Our assets are either in my name or joint names.

    I hope I explained the situation well enough.

    Only what is attached to the corporate name can be taken. Say if your house is under the corporate name, they could attach that to the debt. You obviously worked out of the home and not for your husband's company, right ?

    First it depends on the nature of the debts. If these are corporate debts then they can only go after the corporation. If these are personal debts that he alone signed for, then it will depend on your state laws whether they are part of the marital property. However, even if they are not considered yours, any assets that he is listed as an owner of, can be attached.
