On H1-B, you can file resident tax return for 2007 even if you did not complete Substantial Presence Test in 2007 but complete in 2008. You will then attach ITIN of your spouse and child with your tax return.
It is hard to tell why your ITIN was rejected as you did not provide enough information. When did you start on H1-B? What type of return did you file? What was your reason for filing W7 (as checked on W7 form)? Why was the ITIN rejected?

I am here in us from 2006, my family joined me in 2007, the itin were rejected because I had sent the tax return form along with it. That was the only reason. So I am reapplying for the itin. I would like to know that if I refile my tax will I be able the to get the supposed tax refund? Please advice

    Thanks and reagrds

'the itin were rejected because I had sent the tax return form along with it."
This reason does not appeal me.
May be you should consult AtlantaTaxExpert at [email protected] and file W7 through him.

Sorry I had typed wrong. I meant to say that I didn't send the tax returns along with the w7 form. That is the reason itins got rejected.

Then re-submit the Form W-7 WITH the tax return.

It will probably take abot two months to get processed, as the ITIN Processing Center at Austin, Texas has been unindated with returns and ITIN applications.

Is it possible for me to refile the tax and get the supposed tax refund?

Yes, but the refund will be a LOT smaller if you do not get an ITIN for your spouse.
