My sons father wants to sign over his parental rights. How do I go about that without the costs of an attorney? I live in WA state.

I have a fiancé that wants to adopt my son. The biological father wants to give up his rights. The father currently lives in Germany and I' m in WA state. I want to make this a s quick and painless as possible.

Hyou can't. First unless you have a new partner that is willing to adopt, it is very unlikely that the court will even allow it. But to get to court you will need an attorney. Next he needs to understand that even if he gives up his rights ( that is right to visit) he will still be obligated to pay child support.

Attorney does all the motions, sends father paper work to sign, he signs it and has it notorised and sends it back.

You've posted 2 variations of this situation - should be combined, unless you are talking about 2 different children.

So here goes... I got pregnant and he decided he didn't want to be involved. I moved back to the states and he has had very little contact. I have a fiancé that my son already thinks is dad. He is more than willing to adopt him. I asked the "real" father if he would sign his rights over and he agreed. Now I just am hoping I can do it without the expense of an attorney?

Nope, use the attorney, adoption into itself, there are some sites where you can download the forms, but since this involves someone from outside the US, and issues of legal service. Also since this stops all of the child support for the bio father, he shouild be happy to kick in for the attorney. ( part of it anyway)

you did not tell us the state, but if you do a Yahoo or Google search for step parent adoption forms ( and list your state) you should get the forms to use, Personally I still would not do it without an attorney

There are hiundreds of threads here that already answer this question.

Get married first. Check with your local courts to see how long you have to be married to petition for adoption. Then get an attorney to file the asoption papers which will include a TPR for the father to sign.
