    Hi -

    My fiancée and I recently had our bank account attached. We were never served with any papers that the creditor was going to court. Can you tell me if they can do that without notification and also, what they got doesn't come close to what is owed - will they keep doing that or is it a one shot thing? We live in Rhode Island... thank you for any help!

    There is no notification for a garnishment ( that would be pretty silly since people would move the money) You should have at some point been notified of a hearing for a judgement, that could have even been several years ago. But they may attach bank accounts, attach your pay check once they have a judgement until they are paid back in full.

    If you were never notified, you may go to the court and check the records and make a motion to have the case dismissed due to improper service.
