    I own a house and I put it up for a loan from my nephew and now I'm going to pay him off do I need to get a quitclaim deed or a warranty deed from him?

    Hello C:

    It depends on how/or if the house was transferred to him in the first place. Most loans of this type are handled with a mortgage, not an ownership transfer. So, if you did it that way, I imagine a quit clam deed would put it back. But, don't do that again.

    I depends on what you did? Sounds as though you either gave him a mortgage or title to your home. If you gave him, say, a promissory note and a mortgage, when you pay him off, he will mark the note "Paid in Full" and mark the mortgage "Satisfied". The mortgage is customarily filed in the deed records of the courthouse and he must notify the clerk that the mortgage has been paid and request that it be marked "Satisfied"; otherwise, the deed records will show you have a lien to your nephew, though you have paid the debt.
