    Is employer responsible for payment of injury?
    At my last place of employment (Florida), I was hurt on the job. The employer did not carry workers compensation. He had a total of 5 employees including him when I started. When I got hurt there was only 4 of us. Since he did not carry workers compensation Insurance, I used my own insurance (from my husbands place of work) and paid for the doctors visits myself. This happened in August of 2007. I went to my primary and she said I had tendinitis in the elbow and gave me a band to wear on my arm which did nothing. I went to an acupuncture doctor just 4 doors down from where I worked . I tried his first suggestion and had acupuncture done which I had to pay full out of pocket for. That just bruised my arm any where he put the needles. His last resort was cortisone shots. I had 2 shots which the insurance paid for them and I only had to pay my co payment on each visit. The shots worked up until 2 months ago. Now the pain is back and its worse. I no longer work for this company and wonder if the employer is suppose to pay or not.

    You would have to take him to court, and sue for your damages.

    I would speak to an attorney, most will consult the first time for free, just to see what your options are.

    Before you sue, I would contact the employer and send him a bill for your out of pocket expenses. If he doesn't pay, then you can sue.

    You needed to file a workers comp claim with the workers comp division. There is a time limit on how long you can file. It does not matter if he carries insurance or not, he should have been writing checks for everything, if fact your health insurance is to be paid back by him, since they are not liable normally for accidents at work.
