    How do I get tenants out who do not have a lease? The tenant also has 2 kids, she is 2 months behind on rent working on 3

    You have to serve her with an eviction notice. How many days notice depends on what state you live in. If she still doesn't leave you need to go through the district court and constables.

    1. You should not be a landlord if you don't have all of the legal issues known before you rent the first day, sorry but you are suppose to be in business.

    2. next you are not a charity, you are suppose to give them notice and start eviction before they get 30 days behind unless you are a charity.

    I know this sounds hard and mean, but you saying they have two small children, as a business who cares?? They can have 4 kids, and two dogs and will be on the street living in a shelter when you evict, as a business you have to worry about paying your mortgage and taxes and making a profit.

    So you depending on your state, there is a sticky at the top of this page with the various state laws on it, here you give them a 3 day pay or quit notice and if they don't move or pay in 3 days you take them to housing court to get a formal eviction.
