Reclaiming Insurance paid for the past 4 years
Whilst checking recent transactions and cancelling some Direct Debits over the phone to my bank, the assistant went through the payments I was making on a regular basis. A company was mentioned and I asked further, thinking it was a charity that I had been donating to. I was given the telephone number by my bank so that I could make enquiries before cancelling. I found out it was an insurance company, and, that I had been paying for insurance for a mobile phone.
To cut a long story short, I was told that the mobile phone company may have set up insurance on my behalf when I entered into the contract 4 years ago.
I then found out that the telephone company (whom I thought I took out the contract with) was actually a third party company. The company has since gone into liquidation and being managed by another.
The insurance company said that I need proof that I did not set up the insurance.
Has anyone had any problems like this and able to help.
I do not know where I stand on this matter or whether the Direct Debit Guarantee Clause is the next avenue to pursue.
I have made a claim for 42 payments to be refunded with the Indemnity Department at my bank, and so far only received one months refund. Can the insurance company refuse to pay? I do not have any paperwork about them as I did not set up any insurance with them.
I know I should have been more observant but somehow the payments I made went undetected as it is (was) only £5.99 per month which is the same amount I have been paying to 2 charities.
