    Child support court order in another state
    I divorced in 1997. Support order was for 62.37 a week for 2 kids.I have been fighting this for 10 years between states.. States are ILL/FL;;Finally I hired a private attorney took ex back to court in 2007 with 16400 in arrears.Still ILL hasn't updated their Support to the new order of 175.00 a week no arrears until older child graduates high school... They still have him paying 62.37 a week and 12.88 in arrears.FL can't seem to get them to update faxes and letters have been send back and forth.. No one in ILL will talk to me due to the case I have with FL.. How do I get the new court order updated in ILL?Now they say money is owe to public assistant and is taking what 2 payments of 62.37 he is making to me for that.How do I find out how much is owed?.

    Are you currently handling your case through your private attorney or through a state agency in FL?
    I noticed you said letters have been sent back and forth between FL and IL... what does the state of IL have to say about the new court order?
    So, IL is taking the child support ex is paying and redirecting it to pay off the public assistant... if I were you, I'd demand to see a bill, one clearly showing the full balance owed...
    Are you in contact with the state child support agency in IL? Keep trying to do so... someone there should be able to direct you better on what to do to get your court order observed...

    Are you doing this yourself or using an Attorney?

    It sounds like something you can't do yourself - support between States is very, very difficult in many cases - and you may need an Attorney in IL to work with the one in FL.

    Extra money, of course, but I think it's the only solution.

    Are/were you on public assistance (which I think is what you mean)? Is that what you are expected to pay back?

    Florida is handling the case that's were I live .I hired a attorney in Ill to modify the support.And that's all the attorney did.Once court was over was done .Didn't make sure order was entered into system nothing.

    Then I'd contact the Attorney who got the Order and then didn't file it - that's the person at the root of the problem.

    Let me get you to confirm a few facts.

    1) Does your Ex lives in Illinois and was that where the original divorce was processed?
    2) At some point did you apply for an collect public assistance in Illinois?
    3) Did you file for your modification in Ill or Fl or both?
    4) Have you contacted the atty in Ill about filing the modification?

    Yes ex lives in Ill.. Yes 9 years ago I collected public assistants.File modification in both states.But they only started taking out this year never before.And the attorney said the they were done it was signed by the hudge but never entered into the system.Since they said this money is owed I am not getting anything...

    Ok, Since you did collect public assistance, the state is entitled to reimbursement for what they paid you. However, you are entitled to an accounting of that money.

    The Ill attorney should either forward the modification order to the agency collecting the support or tell you how to do it.

    What you need is to cut through the bureaucracy and keep badgering people until someone does their job.
