Georgia-- pension garnishment
My mother (94) Georgia resident/retired NY State teacher received her first mailed debt recovery claim regarding credit card debts over 3 yrs ago--incurred due to a terminal family illness--her only income and assets involve the monthly deposits of her pension and SS benefits (approx. 3k/mth) into our joint bank acct.---Is this garnishment protected?
Is she judgment proof as told to me by an Atlanta bankruptcy mill?
In Georgia aren't pensions of Teachers garnishment protected?
Bad credit doesn't matter now as she's in very poor health. Should I confront the creditors by phone or work through written legal assistance?
I have 30 days to respond to the National Arbitration Forum (they are an arm of MBNA debt recovery) --and would like to confidently tell all future debt collectors that they have no recourse to collect anything------I'd like to avoid the stress and expense of chapter 7. ---I've done research into Ga. Law RE: garnishment exemptions--
She appears untouchable---true?
