    Legal separation
Can I get child support if I'm not legally separated?

You can get child support if you are not ever married to them.
You file for temp custody of the child in family court and get a temp order of support pending the actual child custody and child support hearings.

You have custody of a child? " Child support is the most litigious aspect of a divorce case. Most issues that come up during the divorce process are resolved once and for all by the final decree of divorce but child support and issues surrounding it may go on for years after the divorce is final. Each state has it’s own laws and guidelines on how child support is calculated." See: Child Support - How is Child Support Calculated?
