    Filing tax return after H1B cancellation
    Hi All,

    Need some guidance on my case.
    I got my H1B in 2007 and worked there for sometime in
    2007 and little less than 3 months in 2008.
    I filed my tax return for 2007.
    Now due to some reason I had to come back to India and hence
    I resigned from my job in US.
    My employer is cancelling my H1B visa now.
    I have few queries on the same:-

    1. Is there any problem getting a visa again if once it is cancelled.

    2. Do I need to file my tax return for 2008 ? Also since I worked there
    For some time, I'am expecting some refund in this case ( worked
    Less than 90 days). But confused if same can be done as my visa will
    Be cancelled by that time and I might not get the W2 from my employer.

    Please guide me.

    If the reason for cancellation was unsatisfied performance only, then this should not have any effect on you applying for a visa in the future, BUT if your employer reported other reasons to USCIS such as illegal activities or using false documents, etc., then you're history.

    2. Do i need to file my tax return for 2008 ? Also since i worked there
    for some time, i'am expecting some refund in this case ( worked

    be cancelled by that time and i might not get the W2 from my employer.

    I would suggest filing tax return even your income does not meet the requirements since you may be asked for this document when you apply for visa next time. Check with Tax Expert.........
