    Criminal law 321
    I live in canada I just recently got a management job with a retail store they have done a back ground check it was fine I got the job OK fine here the question since getting the job I was with someone in another retail store an they stole something I was charged cause I was with them I was found guiltyof theft under 5000 even though they have done the check will they do it again an can I do anything like get the record sealed or expunged any advice would help

    Straight from Canadian Law: "When can you apply to have your record sealed? For Summary Offences: 3 years after your sentence has been satisfied.
    For Indictable Offences: 5 years after your sentence has been satisfied.
    What is the Process for Granting Pardons?

    You must first apply for a Pardon. Your criminal record is not automatically sealed after a certain period of time. Once you have applied, you will be granted a Pardon as follows:

    Summary Offences: The Board has confirmed that you (a) completed your 3 year waiting period; and (b) have not been convicted of any other offences since your last conviction.
    Indictable offences: The Board has confirmed that you (a) completed your 5 year waiting period; (b) have not been convicted of any other offences since your last conviction; and (c) have met the “good conduct criteria”."

    Will your employer update your background check? Depends on the employer - there is no rule of thumb.

    This is the problem, of course many places run background checks from time to time. You are as guilty as the other person since you did not stop them, and would you have stopped that person in your store??

    You don't even seem to think it was wrong??

    The arrest was in April and that post mentioned nothing about this management job - did you get the job before or after the arrest?

    Or are there two arrests?

    Just one arrest an yes I know it was wrong I take responsibility for it the arrest was right in the process of hire I didn't know if I was going to be found guilty or not
