    It depends on the fraud - was your father coerced or unduly influenced? Is it a "pretend" Will? Was the probated Will NOT the last Will?

    Yes there is a will. The problem is a family member had poe over dads financial and
    Health issues while in nursing home.in this time he hoarded all assets in his position.will not talk about said will with rest of family.attorn has asked for deposit to get things rolling but he said we need to split the cost.he is holding ample amount of dads money for this but refuses.

    It would be my advice that you DON'T pay THIS attorney a nickel. You need to get YOUR OWN attorney to represent YOUR interests. Forget the criminal stuff. Go get YOUR MONEY!!

    What Excon said - plus I don't see criminal behavior here. If your brother refuses to put the Will into probate, then go to Probate Court and they will force the issues (at least in NYS).
