Where to begin.. 8 months ago I was charged with "felonious assault" for firing a gun into the ground in a rural area because my seasonal residence was being broken into. This is all documented in police reports. The caller to 911 for the gunshots fired lived over 2 miles away. Anyway, the police thought I fired at the person sleeping on the couch at the time-drunk and passed out. I upon my arrest asked they b e removed from my residence-still insisting somebody was trying to break-in.
I was taken to jail and low and behold 1 1/2 hour later I had my Harley stolen and completely gutted cabin. The police have done very little follow up but what they have done is avoid everything. They failed to secure my property and I need to know where to go from here. Also the charges were dropped 11days later and even my handgun was returned.

Don't you have homeowner's insurance? Didn't they cover your losses? I would discuss the situation with them. They may decide to go after the police for negligence in their duties. But it's a longshot.

My homeowners covered the contents but the Harley had only collision and no theft due it having fleet insurance.

One law obeying, honest, tax paying citizen vs. A Police Department.

When my place got robbed I had to track down my stuff myself and tell the cops who did and where he lived before I got them to do anything.

The only thing you can do is call the detective working on your case everyday and ask him what he has done on your case today or get a lawyer and see what he says about it.

Goss - have you tried to interest an attorney in your case so that you could sue them for not properly securing your home?

Did the police actually fail to secure the cabin? Did they let you lock the doors, etc. I'm trying to figure out what responsibilities the police had that they didn't fulfill.

There should be some agency in your area to which you can report what you consider to be improper police conduct. In my area, its called the Citizen Complaint Oversite Panel. Getting a lawyer as suggested above, or at least talking to one, sounds like a great idea.

I was never allowed to lock the cabin doors myself- nor did they remove the person that was there at the time of my arrest. I specifically requested that they be removed from the property.
