    Roommate broke lease
    I had a room mate in Florida who decided to move out of our 1 year lease after only two months into the lease. The landlord already said we lost our deposit, I am staying at the residency but was wondering what the legal time frame was that she has to give? She gave me less then 1 months notice, she has also stolen and I have her on camara after I left my house of her coming in vandelizing my property. I need to know what I can take her to small claims court for. Thanks for in advance for your help.

    Why would you lose your deposit if you remain in residence? Were you both signed on the lease?

    If you have proof of her vandalizing your property, why haven't you called the police?

    You certainly can sue her for her share of the rent and any property damage she caused. But collecting may be a problem.

    Yes, as long as you are still there and paying the rent, you would not lose any deposit. You can sue your room mate for their 1/2 of the rent, as long as you are paying the full rent. Or are you merely paying 1/2 of the rent to the landlord and he is losing the other 1/2?

    If someone stole or destroyed property, you call the police and sue in court.

    For a signed lease, there is no notice you can give, you have to stay for the entire lease unless the landlord breaches the lease
