    Divorce with the first green card
    I got marriage in November 2005, I got first green card that is expired in September 2008. This June 2008 I need to file a form for my second green card. My husband is thinking about divorse. He told me about this. Do I have any chance to get my second green card if he divorce before the experation of my first green card. Even if I send already my form for a second one.

    If you are still married, the petition should be filed jointly by you and the spouse through whom you obtained conditional status. However, you may apply for a waiver of this joint filing requirement if you entered the marriage in good faith, but the marriage was later terminated due to divorce or annulment.

    You need to provide supported documents and since this is a 100% success rate, this matter should be handled by experienced immigration attorney.
