My dad just passed away and he had approx. $7000.00 in credit card debt. He is the only name on the credit card. He had no real assets to speak of and was applying for Medicaid at time of his death. He had $270.00 in savings and approx. $3000.00 in checking. What assets can the crdit card company look at and who os responsible for credit card debt.

After you take the 3270 an pay for his funeral, there is basically nothing left, You send a copy of the debt certificate and a letter stating there is nothing in the estate. They will ( if they are a lower level collection people) try and call and scare you by telling you that you have to pay it. But in your original letter inform them not to contact you by telephone in regard to this debt.

Basically if there is nothing, they get nothing and have to go away.

Thanks for your answer. The only thing I do have to say is the funeral was prepaid by my dad on his credit card a month before his passing. The $2000.00 in the checking account was there so no checks would bounce. In addition the checking account was a joint account with me on the account but not on the credit card. I used to help him out whenever I could. Does this present any problems for me?

No it doesn't. If the checking account was joint with right of survivorship then it passes to you outside the estate.

The only possible issue I can see is that your dad committed a fraud in charging the funeral costs when he obviously knew he was going to die shortly. But you still would not be responsible for that.
