    SS/Medicare refund process
    Hi AtlantaTaxExpert,

I have been getting most of my queries solved on this forum, thanks a ton for answering all the questions people ask.
I have a short question on claiming refund on SS/Medicare taxes withheld during OPT period.
My previous company withheld the two taxes while on OPT. From your suggestion to other posters I think following is what I need to do:
    1. Get a letter from employer stating that they won't refund the SS/Medicare.
    2. Submit form 843.
    3. Write a letter explaining why I am claiming a refund (siting #1 above)

However, in my case my pervious company was acquired by another company and hence it no more exists. As a result I can get #1. Can I state that as a valid reason (in #3) for not getting the money back from my employer?

    TIA

    Tia:

Yes, having the former employer company bought is a valid reason for not getting the letter. In that case, there is a form you can file.

Download IRS Pub 519 and read page 45-47 for the process of requesting the refund. The Form is 843.
