    Terminating a fathers rights
    I have an 18 month old and about 5 months ago I left her father. He stopped working 2 months before I actually left, never changed diapers, gave baths, fed dinner, changed clothes, I could go on forever. It got to the point that my daughter was going to the bedroom door and knocking... the bedroom is where he spent almost all his time because that's where the computer was. So, since we have left he hasn't tried to see her, he still has no job, pays no support, and he was supposed to report to jail on 6/9 for his 2nd DUI and he never showed up. He is unfit and he doesn't care. Im worried that if something were to happen to me next year he would be able to take her and no one would be able to do anything about it. What do I have to do in order to have his rights terminated?

    What good would that do? This is the Family Law board. Any answer should adhere to the laws.

    You have to file a petititon in your local Family Court to have his rights terminated. Given the facts as you present them, there is a possibility it will be granted, but the odds are not in your favor. What is more likely to happen is you will be granted full physical and legal custody and that he will be given no visitation or only supervised visitation. The court will be more inclined to give him a chance to clean up his act rather than cut him off.

    You will stand a better chance if you get an attorney to help you through the courts. An attorney familiar with the local Family Court can advise on your chances.

    Yeah I understand! I just thought that the law differs from a state to another and that maybe she can keep her daughter in another state?:confused:

    First, there is really very little danger of her losing her daughter given the circumstances. Second, its not that easy picking up and moving. Third, your answer really didn't deal with the legal issues.
