    Land Contract Questions on Septic
    I have sold my home on a Registered Land Contract . At the time of sale I did not realize that Michigan Law requires a septic check. We did have one about six months before and that did pass.
    The new buyers had a problem with their septic and had it pumped out. But we ended up having a new drain field and inspections done to resolve all problems.
    When they sent their payment is was less the amount of pumping of the septic.
    If they purchased a home as is on a Land Contract can they do this ? We realize not only legally but morally we had to fix what ever was wrong as far as not every day home ownership requires.
    Am I wrong to think that they should pay for the pumping ?

    Ok, morally, and the pumping is a small amount I personally would have paid it.

    BUT this is the issue, if they have a land contract they do not own anything yet, so legally you still have the deed, the contract is when registered acts as a hold to stop you from selling it to someone else.

    Normally in the contract you will have spelled out that they are responsible for all upkeep and all things such as insurance and taxes. But to be honest even on my contracts I always keep my own insurance up on the property only since if they let thiers laspe, I could loose my investment.
