And he's worried that he's illegal

This depends on where you live, the age of consent various by states ( in the US) and by county world wide. In some places the age is 16, in others it is 17 and in some it is 18. So if the legal age of consent in your state is 18, and someone files a complaint on him, yes he could be. But at this point you have to be concerned about the baby, and making a home for the child.
