    Child custody
    I am a marine and I will be getting leave here soon, when I was deployed my wife took our son back to Minnesota and is living there. We are in the process of a divorice, we have not had a court date yet. When I go home on leave I want to bring my son back to ca with me. Can I do this without being thrown in jail.

    Until there is a custody order, you have as much right to your children as does your wife.

    Welcome to AMHD. You mention you are in the process of a divorce. Are there lawyers involved, or is the divorce homemade? I hope you have an attorney and follow your attorney's advice. My concern for you and your son is that you may engage in a custody battle that will forever sour your son's relationship with his parents; and that your son will assume responsibility and blame for your disputes.

    The custody order I referred to above, would have course, include ANY order, even temporary ones. I wasn't remiss.

    I understand. I just didn't want to create a false hope for the OP. I know you knew better : )


    Its just a lot of times when being hit with all the paperwork and the drama that goes with it its difficult to understand the process because it can vary so much from state to state.

    Legal and her letting you take him may be two different things
