    My landlord wants to install new carpet doing the work himself. The house does not really need new carpet. If he does the work himself it will take at least 2 weeks; not to mention when he starts taking off the base boards to replace the carpet it will chip all the paint then will have to be repainted. Also, we will be required to move out all furniture in the mean time and will be very misplaced during this time. We have not complained about needing new carpet. Do we have to let him do this?

    I think you do. However, if this work will disrupt your life in YOUR home, he should put you up in a hotel for however long it takes him.

    You CAN force the issue. I'd write him a letter mentioning the above. You are entitled to a dwelling that is "fit for the purpose it was intended for". That's verbiage from the "habitability" warranty that ALL landlords are required to adhere to.

    Forcing you to live WITHOUT furniture for two weeks isn't habitable at all.

    First I can't see how new carpet would take wo weeks, perhaps one day per room, but it is his home ( he owns it) and yes he can.
