    Can a payday loan company ganish your paywages by just calling the payroll department at your company without a court order?

    With few exceptions (primarily government debts) garnishment orders have to be issued by a court. However, I would read the contract you signed. Its possible, that you put your paycheck up as security for the loan and you may have given them the right to garnish your wages. All they might have to so is show your job the contract.

    Most payday loan places ( legal loan sharks) have paper work in the contract that you sign, that allows them. You normally sign permission to garnish when you get the loan. They just provide your work place that notice and they can get paid directly from your work.

    If you did not sign this, they will have to sue and get a judgement before tey can garnish.
