My roommate is trying to evict me and I have nowhere to go!
I am currently living with a friend, in a house that she owns in Atlanta, GA. I have lived here since August 2007. I pay monthly rent, however, I have never signed a lease. Recently, she told me that she no longer liked living with me because I was loud, and she needed peace. She asked me to move out. It's her house, I don't have a lease, and she didn't give me a date to move out by, she just said immediately. I have money order receipts from some of the months I've paid her. But some months were paid in cash. I also have emails that she sent me before I moved in, saying I could move-in and pay monthly (not sure if those will count as any proof). I also paid her a security deposit when I moved in.
I read some of the other answers on this site. So it looks like she has to give me 30 days notice, and then file a formal eviction. My question, is how long would that take? I ask because I am moving to Texas anyway on August 1st, and it would be a great hassle to try to find somewhere to live just for a month and a half. If she goes through the formal process of evicting me (which she hasn't yet). How long after the 30 days would she be able to physically evict me? Meaning if the court grants the eviction, how long from the day she files, would it take for them to enforce it?
Also what do I do if she changes the locks? I read that I can sue, but what do I do in the meantime since all of my belongings are here, and I have nowhere else to go. If I come home one day, and the locks are changed, can I call the police? Will they be able to force her to let me in, or can I do that since I don't have a lease?
Sorry this is so long... but I don't know what to do for only seven more weeks.
